ACKNOWLEDGEMENT & ASSUMPTION OF RISK

I, {name}, acknowledge that Bora BJJ Inc. operates a Brazilian Jiu-Jitsu and martial arts academy (the “Academy”) and provides training, instruction, sparring, conditioning, and related activities, whether supervised or unsupervised (collectively, the “Activities”).

I understand and acknowledge that participation in Brazilian Jiu-Jitsu and martial arts training involves inherent risks, including but not limited to:

• physical contact with other participants
• falls, throws, takedowns, and submissions
• strains, sprains, broken bones, joint injuries
• concussions, paralysis, permanent disability
• exposure to bacteria, viruses, and contagious diseases
• serious bodily injury or death

I understand that these risks may arise from my own actions, the actions or inactions of others, the condition of the facility or equipment, or the negligence of Bora BJJ Inc. and its representatives.

I voluntarily accept and assume all risks, known and unknown, associated with my participation in the Activities.

HEALTH & FITNESS REPRESENTATION

I represent and warrant that:

• I am physically and mentally capable of participating in the Activities
• I have no medical condition that would make participation unsafe, or I have consulted a physician prior to training
• I will immediately stop participation if I feel pain, dizziness, injury, or discomfort

I acknowledge that Brazilian Jiu-Jitsu is a high-impact physical activity and that injuries may occur even when proper instruction and supervision are provided.

INSPECTION & CONDUCT

I agree to inspect the training area and equipment before participation.
If I observe any condition I believe to be unsafe, I will notify Academy staff immediately and refrain from participation until the condition is addressed.

I agree to follow all Academy rules, safety guidelines, and instructor directions.

RELEASE OF LIABILITY & INDEMNIFICATION

In consideration of being permitted to participate in the Activities, I hereby release, waive, discharge, and covenant not to sue Bora BJJ Inc., its owners, directors, officers, employees, contractors, instructors, volunteers, affiliates, landlords, and agents (collectively, the “Released Parties”) from any and all claims, demands, damages, losses, costs, or causes of action arising out of or related to:

• participation in the Activities
• use of the Academy facilities or equipment
• injury, illness, disease, disability, or death
• property damage or loss
• negligence of the Released Parties, to the fullest extent permitted by law

I further agree to indemnify and hold harmless the Released Parties from any claims brought by me or on my behalf.

CONTAGIOUS DISEASE ACKNOWLEDGEMENT

I acknowledge the contagious nature of diseases including, but not limited to, COVID-19.
I understand that while Bora BJJ Inc. may implement safety and sanitation measures, no guarantee can be made that I will not be exposed to or contract a contagious disease.

I voluntarily assume all risks related to exposure and release Bora BJJ Inc. from any liability related to such exposure.

PHOTO, VIDEO & COMMUNICATION CONSENT

I consent to being photographed or recorded while at the Academy.
I grant Bora BJJ Inc. the right to use my likeness, image, voice, or video for marketing, promotional, instructional, and commercial purposes, across all media platforms, without compensation.

All media recorded within the Academy is the intellectual property of Bora BJJ Inc.
Permission may be withdrawn in writing at any time.

INTELLECTUAL PROPERTY

I acknowledge that all training programs, class formats, instructional methods, and materials used at Bora BJJ Inc. are proprietary.
Any reproduction, recording, or distribution without written permission is strictly prohibited.

MINORS

If the participant is under 18 years of age, this waiver must be signed by a parent or legal guardian, who agrees to all terms on behalf of the minor.

GOVERNING LAW

This agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
Any disputes shall be resolved exclusively in the courts of Ontario.

FINAL ACKNOWLEDGEMENT

• This agreement is binding and irrevocable to the fullest extent permitted by law
